well the ul was missing but i did not expect it to effect the form because this is form browser to guess that it must be closed

it must be a CSS conflict, but it is not flexicontent CSS core files , i have unloaded them with no effect.

also tried deleting the form container with no effect

We found an HTML misclosed tag for the form, thanks for feedback ,

i checked and there are no other such unclosed tags (although potentially a page produced dynamically can have HTML misclosed tags in case that PHP code is outputing correct HTML)

You mean the missing </ul>, yes unclosed tags can cause troubles, but e.g. a missing alt="" in a image is of less importance (non-compliant to standards but no serious trouble)

In our past sites the form was braking the footer div, I never found the bug.

I thought it was some div in JCE but I was wrong.
I need to learn to always post the bugs.
